Measures for the administration of parking fees

  In order to give full play to the guiding and regulating role of price lever, guide citizens to choose reasonable modes of travel, reasonably divert motor vehicles, effectively regulate parking charging behavior, safeguard the legitimate rights and interests of motor vehicle park owners and service providers in parking lots, and further alleviate traffic congestion and parking difficulties, Hangzhou is now further strengthened and improved according to the Price Law of People’s Republic of China (PRC) and the Measures for the Construction and Management of Motor Vehicle Parking Garages in Hangzhou (Decree No.273 of the municipal government).
  I. Scope of application
  These Measures shall apply to motor vehicle parking fees and supervision and management within Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Hangzhou High-tech Development Zone (Binjiang), Hangzhou West Lake Scenic Area and Hangzhou Economic Development Zone (hereinafter referred to as the urban area).
  The term "motor vehicle parking fees" as mentioned in these Measures refers to the act of providing parking services for motor vehicles and collecting fees.
  Second, the pricing form of motor vehicle parking charges
  Motor vehicle parking fees are managed by combining government pricing with market-regulated prices.
  (a) the following motor vehicle parking fees shall be subject to government pricing management:
  1. Urban road parking fees;
  2. Charges for supporting parking lots with monopolistic nature, including charges for supporting parking lots such as public city squares, civic centers, stations, docks and tourist attractions, and charges for parking in designated parking lots for traffic accidents (faults) and illegal vehicles;
  3 public (profit) units supporting parking fees, including party and government organs, institutions and hospitals, libraries, museums, stadiums (institutes), youth activity centers and other units supporting parking fees;
  4. Public parking fees invested by government financial funds;
  5. Before the establishment of the owners’ meeting, the public parking lot in the residential area (including the road parking berth in the residential area) will be charged.
  (2) In addition to the above-mentioned government pricing management, the fees charged by other types of parking lots are subject to market-regulated price management, and the service providers of motor vehicle parking lots set their own prices according to the principle of compensating reasonable operating costs and paying taxes according to law.
  Three, motor vehicle parking fees
  Motor vehicle parking charges are based on the principle that the central area is higher than the non-central area, the road is higher than the off-road, the non-residential area is higher than the residential area, the daytime is higher than the night, the long time is higher than the short time, and the tourist season in the scenic spot is higher than usual.
  (1) Free parking for road parking spaces in unattended areas with small parking demand; Parking fees should be charged for road parking berths with large parking demand and attended. Urban road parking fees are charged in different ways and standards according to different regions and time periods.
  According to the traffic situation and the supply and demand of berths, the dynamic adjustment mechanism of parking charge area is established. According to the traffic congestion index, the average speed during peak hours, the utilization rate and turnover rate of road berths, the average parking time and other factors, the regional level of parking charges will be dynamically adjusted, and the traffic management department of the public security organ will put forward specific opinions in conjunction with the price department and the urban management administrative department, which will be promulgated and implemented after being approved by the municipal government.
  (II) The parking fee standards for supporting parking lots with monopoly nature, supporting parking lots for public (beneficial) units and public parking lots invested by government financial funds, which are subject to government pricing, shall be examined and determined by the municipal price department on the premise of comprehensively considering the factors such as reasonable compensation for operating costs, parking lot facilities level, geographical location, service conditions, market supply and demand and social affordability, and maintaining a reasonable price comparison with road parking fees in similar areas.
  For parking lots with prominent parking contradictions that are priced by the government, the operator shall apply for it, and the step-by-step charging method can be implemented after being examined and confirmed by the municipal price department.
  It is determined to be a "P+R" parking lot (garage) with the function of transferring to public transportation, and the transfer of small cars will be subject to preferential charges. The specific preferential measures will be formulated separately by the municipal price department.
  (3) In order to alleviate the road traffic pressure in Hangzhou West Lake Scenic Area, the charging standards for parking lots and road parking berths in Hangzhou West Lake Scenic Area will be raised during the legal holidays and weekends in the tourist season. At the same time, in order to encourage self-driving tourists to enter the scenic spot by transfer, the tourist distribution center (transfer center) will park their small vehicles free of charge with the transfer credentials.
  (IV) Parking in residential areas shall be based on the principle of solving the problem of motor vehicle parking of owners (house users, the same below), and the monthly fee shall be given priority. The charging standard shall be determined by taking into account factors such as the affordability of owners and the cost of parking space construction, maintenance and management. In order to alleviate the problem of "difficult parking" in residential areas, if the existing places and facilities in the residential areas really can’t meet the parking needs of residents in the residential areas, the owners of residential areas are allowed to park their motor vehicles in the parking berths set up on the surrounding roads outside the residential areas after examination and approval, and pay the monthly parking fee.
  Before the establishment of the owners’ meeting, if the motor vehicle is parked in the common part of the property management area, the charging standard shall be implemented in accordance with the provisions of the competent price department.
  After the establishment of the owners’ congress, the management system of driving, parking and charging of motor vehicles in the property management area shall be formulated by the owners’ congress. If the owners’ congress decides to charge for motor vehicle parking, it shall determine the charging standard. If the owner has custody requirements for the motor vehicle, the owner and the property service enterprise shall sign a custody contract separately.
  Four, the parking fee charged by the parking lot must meet the conditions.
  (a) the setting of urban road parking spaces should meet the requirements of the total control of road parking spaces in the region, adapt to the parking demand, road traffic conditions and road carrying capacity, and meet the parking needs at different times. The traffic management department of the public security organ shall, jointly with the urban management administrative department, set up and remove them according to law.
  (II) Where the parking lot provides parking services to the society and charges fees, the owner or the parking service management unit entrusted by the owner shall go through the industrial and commercial and tax registration formalities according to law, and file with the traffic management department of the local public security organ 15 days before the parking lot is opened.
  (III) For a special parking lot that provides parking services for a specific object or a specific range of objects, its owner shall jointly formulate a management system for motor vehicle parking and charging within the property management area with the parking service management unit entrusted by it, and implement the management of motor vehicle parking and charging according to the management system. In the conditional property management area, the owners’ committee and the property service enterprise may, in accordance with the provisions of the management system, make overall use of the roads or other venues owned by the owners to set up parking spaces on the premise of meeting the requirements of planning, fire safety and greening. Encourage special parking lots to provide parking services to the society by means of wrong parking when meeting their own parking needs.
  V. Responsibilities of the service providers operated by the parking lot
  (a) in accordance with the provisions of the implementation of the price tag system, in a prominent position in the service place and the place of payment, the charging standard, charging unit, price management form, charging basis, vehicle classification, charging time, free parking time, "12358" price complaint telephone number and other content, and accept social supervision.
  (two) the use of the tax department unified supervision of the bill.
  (3) Be responsible for the maintenance, maintenance and updating of the facilities in the venue, keep the traffic signs and markings clear and complete, and ensure the normal operation of facilities such as lighting, drainage, ventilation, fire protection, safety prevention, environmental protection, sanitation and epidemic prevention, and real-time dynamic information management system.
  (four) to guide the motor vehicles to enter and park in order, and to maintain the parking order and driving order in the field.
  (five) clearly inform the motor vehicle parking start time, end time and effective parking time.
  (six) abide by the relevant provisions of laws, regulations and rules.
  Six, motor vehicle parking responsibilities
  (1) Take care of parking facilities.
  (two) to accept the command and dispatch of the staff of the parking lot, and to park the motor vehicles in an orderly manner according to the traffic signs and markings in the parking lot.
  (3) Pay parking fees according to regulations.
  (4) Abide by the provisions of relevant laws, regulations and rules.
  Seven, improve the management system of fees
  (a) the implementation of parking fees audit and filing system.
  For urban road parking spaces with government pricing, supporting parking lots with monopoly nature, supporting parking lots of public (beneficial) units, and public parking lots invested by government financial funds, parking charging units shall go through the formalities of charging standard audit at the municipal price department before charging.
  For parking lots with market-regulated prices, operators shall go through the filing procedures for charging standards with the local competent price department before charging. The competent price departments of all districts shall report the filing situation to the competent price department of the city every six months.
  (two) the charging parking lot with government pricing shall charge parking fees according to the charging standards approved by the municipal price department, and shall not raise prices, change charging methods or use informal charging bills without authorization.
  The operators of parking lots with market-regulated prices shall follow the principles of fairness, legality and good faith, and it is strictly prohibited to collude in price increases, drive up prices, price fraud and other unfair price behaviors.
  (3) The parking fee income of urban road parking spaces shall be managed by two lines of revenue and expenditure, which shall be fully used for the construction, operation, management and development of public transportation of parking lots and shall not be used for other purposes.
  (four) the management unit of motor vehicle parking in residential quarters shall announce the income and expenditure of motor vehicle parking fees at the end of each year and accept the supervision of the owners or the owners’ committee. The parking fees charged by the parking spaces in the common parts of the residential property management area, after deducting the necessary management fees, are used for the maintenance and conservation of the common parts and common facilities and equipment in the property management area.
  (five) the indoor parking garage provides motor vehicle parking services, and after charging parking fees, no fees such as parking space property management service fees shall be charged.
  (six) the following circumstances are free of parking fees:
  1. Parked in the free parking spaces clearly designated.
  2. Parking in various parking lots for no more than 15 minutes. If the actual parking time exceeds the free parking time, the free parking time will be included in the parking billing time.
  3. Military vehicles (including armed police vehicles), police cars, fire engines, disaster relief vehicles, sanitation trucks, ambulances and municipal engineering repair vehicles that perform official duties or tasks.
  (7) If the motor vehicle parking lot subject to government pricing management takes time as the billing unit, the billing time mantissa shall be uniformly selected: if the actual parking mantissa time is within 15 minutes, the parking mantissa time shall not be counted; If the actual parking mantissa time exceeds 15 minutes, the parking mantissa time shall be calculated as a billing unit.
  (eight) to advocate all organs, enterprises and institutions, social organizations and public places and business premises to provide free motor vehicle parking services to the society.
  Eight, strengthen supervision and management.
  City price, urban management, public security, fire protection, construction, planning, market supervision, finance, taxation and other departments shall, in accordance with their respective responsibilities, coordinate in the management of motor vehicle parking fees.
  Price departments at all levels should strengthen the supervision and inspection of motor vehicle parking fees according to law, and those who violate the provisions on the management of motor vehicle parking fees will be punished by the price departments according to law. Violation of the regulations of public security, fire protection, construction, planning, urban management, market supervision, finance, taxation and other departments shall be dealt with according to law by the relevant departments according to their respective responsibilities.
  If the superior price department has other provisions on parking charges, such provisions shall prevail.
  These Measures shall come into force as of August 25, 2014, and the Municipal Price Bureau shall take the lead in organizing the implementation. The previous Notice of the General Office of Hangzhou Municipal People’s Government on Forwarding the Municipal Price Bureau on Further Improving the Implementation Measures for the Management of Motor Vehicle Parking Charges in Hangzhou (Hangzhou Zhengban Letter [2008] No.211) and the Notice of the General Office of Hangzhou Municipal People’s Government on Adjusting the Road Parking Charge Area in Hangzhou (Hangzhou Zhengban Letter [2010] No.202) shall be abolished at the same time.
